Lease Page 21 Section 4.17: Unauthorized Use Charge. LESSEE shall pay to CITY one hundred percent (l00%) of the gross receipts from any use of the Premises that is not allowed by this Lease, regardless of any related penalties charged LESSEE by competent governmental authorities. Such unauthorized use charge shall be payable to CITY within thirty (30) days after LESSEE receives such gross receipts. No unauthorized use charges shall satisfy or be a credit against any other rent obligation of LESSEE's under this Lease.
After FOX 5 exposed the rotting wood and rusted bolts, a green mesh wall suddenly appeared, blocking all public view. No repairs. No explanation. Public Shut Out as Green Mesh Hides Coaster deterioration and decay.
The screen violates Section 5.9 of the lease, which states: “LESSEE shall not erect, construct or maintain any signs, decorations, awnings, flags or other devices or materials visible from the exterior of the Premises without the prior written consent of CITY.”

This isn’t mismanagement—it’s exploitation. Belmont Park is ignoring the lease, profiting off public land, and putting workers, residents, and the environment at risk. And the City? Nowhere to be found.
It’s time to act. Enforce the lease. Investigate the violations. Stop the abuse of public property and protect what belongs to the people—before it’s gone.

Belmont Park Blasted After “Safe” Ride SHUT DOWN for 4 Days — Public Cries Cover-Up!
Weeks after this report aired, and Belmont Park’s spokesperson misled the public with claims of $1.5 million in repairs and a safe ride, the roller coaster was abruptly shut down for four days of emergency fixes.
We believe serious safety issues remain — and demand a full inspection by an independent engineer selected by the City, not Belmont Park.

Belmont Park’s Giant Dipper, a national historic landmark, is in a shocking state of decay. The photos in this gallery expose rotting wood, crumbling supports, and dangerously weakened beams—and instead of fixing the damage, it appears someone is just painting over it.
This isn’t just neglect—it’s a ticking time bomb. With the level of visible deterioration, it’s not a question of IF an accident will happen, but WHEN. The structural integrity of this nearly 100-year-old roller coaster is severely compromised, and without immediate action, someone is going to get hurt.

Belmont Park is violating its lease across the board.
Every action requires specific written City approval—boom lifts, trailers, chemical storage, signage—everything.
But we’ve searched, and no approvals can be found.
Uncovered 50-gallon drums of oil and chemicals sit outside.
Boom lifts and forklifts are stored in public parking.
Trash is piled instead of properly contained.
A large portable bathroom trailer sits in front of the historic Plunge—unsightly, unapproved, and unsanitary.
A food trailer sits on the boardwalk—again, no written City approval.
Much of the visible wiring appears unsafe or out of code.
Staff are expected to clean hazardous areas without proper safety gear, and water is dumped into storm drains, polluting the beach.
This is not on workers—it’s a management failure by Pacifica Enterprises and Dario De Luca.
The lease is being ignored. The law is being broken. The City is silent.
It’s time for enforcement, accountability, and an end to this reckless abuse of public land.
