Symphony Asset Pool XVI LLC is not managing Belmont Park. It is exploiting it. The City ordered a forensic audit after rent discrepancies passed five percent. The violations were confirmed. Rent was underpaid. Reports were missing. Symphony was forced to pay for the audit. They ignored deadlines, withheld records, and refused to produce documents from shell companies. This was not negligence. It was deliberate obstruction.


Raves continue after explicit permit denials. Construction work has been done without approved permits. Storm drains have been covered, damaged, and polluted. Whistleblowers have reported wage theft. Workers operate in hazardous conditions. Some rides rest on visibly unstable surfaces. ADA violations remain uncorrected. The lease has been violated, the public endangered. 


Belmont is not just cashing in — it’s daring the City to enforce its own laws. So far, the City has refused.

The Ringleader

 Dario De Luca controls Belmont Park from a luxury estate far from the wreckage he leaves behind. Under his rule, families are locked out, disabled residents are traumatized, and a public beach has become a fenced-off festival ground for profit and power. The noise is deafening. The safety violations are blatant. The community is shut out while he cashes in.


Millions in public rent are unaccounted for. His company pocketed $3.65 million in federal relief while workers sued for wage theft. De Luca acts like the laws don’t apply to him — untouchable, unreachable, and unbothered by the destruction he causes.

 BELMONT PARK IS TAKING OVER OUR PUBLIC BEACH, SHUTTING OUT FAMILIES, BREAKING LAWS—AND THE CITY ISN'T STOPPING THEM!


The lease is strict. Even flags, decorations and banners require written City approval. Any type of alteration or change requires written city approval.  Concerts, amplified music, and private events that block public access are not allowed, not permitted, and not legal.


Yet public spaces are fenced off for private profit. Unauthorized events are held without permits. Heavy machinery is stored in beach parking lots. Pollution flows into storm drains and reaches the ocean. Hazardous materials are left out in the open. Stages, lighting, and truss systems are installed without oversight or approval.


This isn’t mismanagement—it’s exploitation. Belmont Park is ignoring the lease, profiting off public land, and putting workers, residents, and the environment at risk. And the City? Nowhere to be found.


It’s time to act. Enforce the lease. Investigate the violations. Stop the abuse of public property and protect what belongs to the people—before it’s gone.

PRIVACY SCREENS INSTALLED TO CONCEAL DANGEROUS VIOLATIONS

 After FOX 5 exposed the rotting wood and rusted bolts, a green mesh wall suddenly appeared, blocking all public view. No repairs. No explanation.  Public Shut Out as Green Mesh Hides Coaster deterioration and decay.


The screen violates Section 5.9 of the lease, which states: “LESSEE shall not erect, construct or maintain any signs, decorations, awnings, flags or other devices or materials visible from the exterior of the Premises without the prior written consent of CITY.”


This is public land. The damage is theirs. The secrecy is illegal. What are they hiding Tear it down. Let the public see the truth.

CITY IGNORES DANGEROUS UNPERMITTED FIRE PITS

 Belmont Park installed large open flame gas pits next to the Beach House bar without visible permits, inspections, or Coastal Commission approvals. Flames have been seen climbing over five feet high in windy conditions. Underground gas lines appear unreviewed, raising serious concerns about violations of state, federal, and local safety laws.


A reported injury and lawsuit in the same area appears to have led to a settlement, yet no safety improvements have been made. Gas pits continue operating without railings, barriers, or visible compliance measures, despite the heavy crowds, children, and alcohol nearby.


The Mayor's Office has allowed Belmont Park to run open flames and hidden gas lines without visible permits or enforcement. Each day these conditions continue, Mission Beach remains exposed to a growing and preventable disaster.

Once the family-friendly Wave House, it’s now the Beach House, trading waves for Raves. 


We believe these events require an ABC Type 90 License, which they don’t appear to have—raising serious concerns that demand investigation. 


Music over 100 decibels shakes homes, echoes half a mile, and disrupts lifeguards.


Chaotic crowds regularly draw police, fire, and ambulances, straining city resources.
